Welcome to Oaks n Stone! These Terms and Conditions ("Terms") govern your use of our website and the interior design services ("Services") we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.

1. Services

Oaks n Stone is a luxury interior design service provider offering a range of services, including but not limited to:

  • Conceptual Design and Space Planning

  • 3D Visualization and Rendering

  • Material and Finish Selection

  • Furniture and Décor Sourcing

  • Project Management and Execution

The scope of work for each project will be detailed in a separate, signed project agreement or service contract. These Terms, along with the project agreement, constitute the complete understanding between you ("Client") and Oaks n Stone ("Company").

2. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information regarding the project requirements, budget, and timeline.

  • Make timely decisions and provide approvals on design concepts, materials, and other project-related items to avoid delays.

  • Grant the Company and its contractors access to the project site as required for design, measurement, and execution.

  • Secure all necessary permits and approvals from relevant authorities, unless otherwise agreed upon in the project contract.

  • Ensure that the project site is safe and free of any hazards for the Company's personnel and contractors.

3. Pricing and Payments

  • Quotations: All quotations provided by Oaks n Stone are valid for a specified period, as mentioned in the quote. Prices are subject to change after this period.

  • Payment Schedule: The payment schedule will be clearly outlined in your project agreement. A non-refundable advance payment is typically required to commence work.

  • Late Payments: Delays in payment may result in project delays. The Company reserves the right to suspend work until overdue payments are cleared.

  • Taxes: All prices are exclusive of applicable taxes (e.g., GST), which will be added to the final invoice as per government regulations.

4. Intellectual Property

  • Ownership: All designs, drawings, 3D renderings, plans, and other creative work developed by Oaks n Stone for your project remain the intellectual property of Oaks n Stone. You are granted a limited, non-transferable license to use these designs solely for the execution of your project.

  • Usage Rights: The Company reserves the right to use project photographs, designs, and related materials for its portfolio, marketing, and promotional purposes, unless a non-disclosure agreement (NDA) is in place. We will respect your privacy and will not disclose your personal details without your consent.

5. Project Timelines and Delays

  • Estimated Timelines: Project timelines are estimates and may be affected by factors beyond our control, such as material availability, shipping delays, and unforeseen site conditions.

  • Client Delays: Delays caused by the Client (e.g., late approvals, non-payment, or changes in scope) may result in extended timelines and may incur additional costs.

  • Force Majeure: Oaks n Stone is not liable for delays or failure to perform its obligations due to events of force majeure, including but not limited to natural disasters, strikes, wars, or government regulations.

6. Warranties and Guarantees

  • Our Work: Oaks n Stone warrants that its design services will be performed with professional diligence and skill. We will coordinate and supervise the execution of the design as per the project agreement.

  • Third-Party Products: We do not provide warranties for products or materials sourced from third-party vendors. Any warranties for such items are provided by the respective manufacturers or suppliers. We will, however, assist you in communicating with the vendor to address any issues.

7. Limitation of Liability

In no event shall Oaks n Stone, its directors, employees, or contractors be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability to you for any claim arising from our services is limited to the amount paid by you for those specific services.

8. Dispute Resolution

Any dispute or claim arising from these Terms or the project agreement shall be resolved through amicable discussions. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (India). The venue for arbitration shall be Pimpri-Chinchwad, Maharashtra.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. The courts in Pune, Maharashtra, shall have exclusive jurisdiction over any matter arising from these Terms.

10. Amendments

Oaks n Stone reserves the right to update or modify these Terms at any time without prior notice. The updated Terms will be posted on our website. Your continued use of our website or services after any such changes constitutes your acceptance of the new Terms.
